Terms of Use

1. Acceptance
By signing in to PulsePoint EQ Connection Polls (the "Service"), you agree to these Terms of Use. The Service is operated by PulsePoint Education LLC ("we", "us"). If you do not agree, do not use the Service.
2. Eligible use
The Service is licensed to nurse educators, faculty, and approved institutional users for classroom, simulation, and clinical pre/post-brief use. You may run the polls with your learners and project results in real time during the session. An account and any pass on it are for one individual instructor. You may not share sign-in access, or a pass, across a department, a program, or multiple instructors. Departmental or institutional use covering more than one instructor requires a separate arrangement with us.
3. Access and payment
Access to the Service is offered through one-time purchase passes rather than a recurring subscription. New instructor accounts get free access to the Starter poll pack, limited to three launches, with no payment method required and no automatic charge. Paid access is available as a Pulse Check pass (30 days), a Semester Pass (120 days), or an All-Access pass, with pricing presented at the time of purchase. Any paid pass unlocks the full poll library for its term. An All-Access pass provides access for as long as we continue to operate the Service as an active service. It is not a guarantee of access independent of the Service's continued operation, and if we discontinue the Service, we will provide reasonable advance notice where possible. We may introduce subscription-based plans in the future as new features are added; if we do, these Terms will be updated to reflect that. Because access is delivered digitally and immediately upon purchase, all sales are final and no refunds will be issued, except where required by applicable law.
4. Upgrades and promotional access
If you hold a Pulse Check or Semester Pass that is still active, the amount you actually paid for it is credited toward the price of All-Access and applied automatically at checkout. The credit depends on that purchase being active at the time you upgrade; once it has expired, no credit remains and All-Access is purchased at full price. We sometimes offer complimentary or discounted access through a limited-time promotion. Promotional access is granted once per account, has its own end date, and carries no upgrade credit, because no payment was made for it. Where a promotion adds time to a pass you already paid for, the credit from that original purchase remains tied to the date it would otherwise have ended.
5. Payment processing
Payments are processed by Stripe, Inc. Card details are entered on Stripe's checkout page and are handled by Stripe, not by us; we never receive or store your card number. Your purchase is also subject to Stripe's own terms and privacy policy. See our Privacy Policy for what we record from a completed purchase.
6. Intellectual property
All poll content, debrief guides, discussion prompts, and the underlying software are the exclusive intellectual property of PulsePoint Education LLC and are licensed, not sold, for your individual use within the Service. You may not copy, redistribute, repackage, resell, republish, or use this content to build or train another product or service, in whole or in part, outside your own classroom use of the tool. Unauthorized use or distribution of this content is a violation of these Terms and may result in termination of your access and further legal action.
7. Learner privacy
The Service is designed to collect no learner data. You agree not to attempt to add or correlate personally identifying information to anonymous responses. See our Privacy Policy for details.
8. Acceptable use
You agree not to use the Service to harass, discriminate, or compromise the dignity of students or colleagues, and not to interfere with the security or operation of the Service.
9. Suspension and termination
We may suspend or terminate access to an account that violates these Terms, in particular the sharing, redistribution, and acceptable-use provisions above, or that is used in a way that threatens the security or operation of the Service. Where the circumstances allow, we will contact you first. You may stop using the Service at any time and ask us to delete your account. Terminated access for a violation is not refundable.
10. Warranty disclaimer
The Service is provided "as is" without warranty of any kind. We do not warrant that the Service will be uninterrupted or error-free, and we are not responsible for educational outcomes that result from its use.
11. Limitation of liability
To the maximum extent permitted by law, PulsePoint Education LLC will not be liable for any indirect, incidental, or consequential damages arising from your use of the Service.
12. Governing law
These Terms are governed by the laws of the State of Arizona, without regard to its conflict-of-laws rules. Any dispute arising out of these Terms or the Service will be brought in the state or federal courts located in Arizona, and you and we consent to that jurisdiction.
13. Changes
We may update these Terms from time to time. Material changes will be communicated through the Service or by email. When you create an account, redeem a complimentary pass, or purchase access, you agree to receive essential account notifications as well as PulsePoint Notes, our periodic newsletter with nursing education insights, resources, and updates. You may opt out of non-essential newsletter emails at any time using the unsubscribe link included in every email.
