1. Acceptance
By signing in to PulsePoint EQ Connection Polls (the "Service"), you agree to these Terms of Use. The Service is operated by PulsePoint Education LLC ("we", "us"). If you do not agree, do not use the Service.
2. Eligible use
The Service is licensed to nurse educators, faculty, and approved institutional users for classroom, simulation, and clinical pre/post-brief use. You may run the polls with your learners and project results in real time during the session.
3. Access and payment
Access to the Service is offered through one-time purchase passes rather than a recurring subscription. A free trial is available to new instructor accounts, limited to one poll pack, with no payment method required and no automatic charge. Paid access is available as a 30-day pass, a 120-day pass, or an All-Access pass, with pricing and terms for each presented at the time of purchase. An All-Access pass provides access for as long as we continue to operate PulsePoint EQ Connection Polls as an active service. It is not a guarantee of access independent of the Service's continued operation, and if we discontinue the Service, we will provide reasonable advance notice where possible. We may introduce subscription-based plans in the future as new features are added; if we do, these Terms will be updated to reflect that. Because access is delivered digitally and immediately upon purchase, all sales are final and no refunds will be issued, except where required by applicable law.
4. Intellectual property
All poll content, debrief guides, discussion prompts, and the underlying software are the exclusive intellectual property of PulsePoint Education LLC and are licensed, not sold, for your individual use within the Service. You may not copy, redistribute, repackage, resell, republish, or use this content to build or train another product or service, in whole or in part, outside your own classroom use of the tool. Unauthorized use or distribution of this content is a violation of these Terms and may result in termination of your access and further legal action.
5. Learner privacy
The Service is designed to collect no learner data. You agree not to attempt to add or correlate personally identifying information to anonymous responses. See our Privacy Policy for details.
6. Acceptable use
You agree not to use the Service to harass, discriminate, or compromise the dignity of students or colleagues, and not to interfere with the security or operation of the Service.
7. Warranty disclaimer
The Service is provided "as is" without warranty of any kind. We do not warrant that the Service will be uninterrupted or error-free, and we are not responsible for educational outcomes that result from its use.
8. Limitation of liability
To the maximum extent permitted by law, PulsePoint Education LLC will not be liable for any indirect, incidental, or consequential damages arising from your use of the Service.
9. Changes
We may update these Terms from time to time. Material changes will be communicated through the Service or by email.
